Can Self-Rep Charge for Services?
When a judge requests a cost submission for fees, can a self-rep submit bill for their services?
Yes, you can charge what you think is reasonable. Self-reps have been reimbursed fees in the range of $150-175/hour.
On what basis are costs awarded?
A successful litigant is not automatically awarded costs. They must show the following (Fong v. Chan, 1999):
- They devoted time and effort to do work normally done by a lawyer
- They incurred a loss in opportunity cost by forgoing remunerative activity during the time they devoted to the case. In other words, the self-rep is given an “allowance” for the lost opportunity to devote time to remunerative activities. The costs must be “moderate” or “reasonable”. A self-rep does not get reimbursed for the time they would have spent as a client if they had counsel.
