What is the case management system?

The case management system was developed out of a need to reduce conflict between parties, to reduce wait times, and avoid the stress of trial in the family court system. This system requires you to attend court for conferences prior to a trial. In these conferences, discussion as opposed to argument should prevail. Discussions allow each party to present their permissions to promote settlement. The three types of conferences are as follows: case conferences, settlement conference, and trial management conference.

 

What do judges do at conferences?

Judges can make procedural orders and orders the parties agree upon. The judge cannot make any other types of orders unless notice is given. The same judge usually hears all conferences in a matter and he/she is called the Case Management judge.

 

What is the point of a Case Management Judge?

Having the same judge at each conference ensures continuity and efficiency since the judge is familiar with the issues and the parties. 

 

When are case management judges assigned?

In the fast track (does not involve divorce, property or arbitration award), a case management judge is assigned before first appearance in front of the judge. In standard track, a case management judge is assigned when either motion or case conference is booked, whatever one is first.
