Summary Judgment

What is summary judgment?

Summary judgment is a judicial process that allows one party to request that the court end the case early if there is no real disagreement regarding the key facts. If it is evident that the facts do not support a claim or defense, the court may reach a final decision without a trial.  A full trial is not necessary when there is no genuine issue requiring a trial. It can be brought for all or part of any claim or defense. It may not include a divorce claim.

Which rule in family law deals with summary judgment?

Rule 16 of Ontario’s Family Law Rules deals with summary judgment.

In what cases, is summary judgment particularly concerning?

Summary judgment is especially troubling since it can be used in child custody proceedings to strip parents of their rights without sufficient procedural fairness. Because of this, parents may lose custody of their children without a fair trial.

What is the test for summary judgment in Ontario?

The summary judgment test in Ontario consists of two parts: first, the judge looks at whether there is enough evidence to decide the case without a trial; second, if a trial is required, the judge can weigh the evidence, assess credibility, and draw reasonable inferences to determine whether a trial can be avoided. These improvements are intended to make the process fairer and more accessible while ensuring a just outcome.
