Types of MTCs

1: MTC (Consent)
If you both agree and you are asking for an order on consent for child support only, you fill out Form 15D.

2: MTC (Consent)
If you both agree and you are asking for an order on consent other than just child support, you use Form 15.

3. MTC (No Response, No Consent)
The respondent has 30 days (or 60 days if outside Canada) to serve and file a Form 15B or 15C. If they do not respond, you can proceed without their consent. You can ask your motion to deal with your MTC, without a hearing or by scheduling an uncontested hearing.Â
File a Form 14B to ask for decision in writing or an uncontested hearing.
No case conference is required.
Clerk distributes the signed order.

4: Proceeding without Consent but does respond to MTC
If you cannot reach an agreement, you must file a Form 15.
Two Ways to proceed:
- You reach agreement and path follows B. Together you file a Form 15C, and proceed for orders on consent other than just child support.
- If there is no consent, ex-spouse files Form 15B: Response to Motion to Change.
